Top wage and hour mistakes NY homecare agencies make

Another situation that homecare agencies frequently encounter is whether you are properly classifying workers as non-exempt when it comes to overtime. Emina noted:

  • Only a small number of categories of workers are exempt from overtime requirements
  • Professional, administrative and executive are the most common categories
  • Administrative is not inclusive of any office employee

Emina explains who falls under the non-exempt category and how you should handle overtime payment for these individuals. Emina also outlines critical mistakes around computing “regular rate,” and failing to track and pay for travel time or spread of hours.
